We, the undersigned, understand that during our participation in the Bastrop Area Rotary Road Rally may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in any driving activity, including road rallies. These hazards and risks include, but are not limited to, personal injury, property damage, and death. We know that these hazards and risks can occur by natural causes, or activities of other persons, road rally participants, rally volunteers, or third parties, either as a result of negligence or due to other reasons.
We certify that the driver of the car has a valid driver's license and proof of insurance as required by Texas Law.
We have read the RULES AND CONDITIONS for participation in the Bastrop Area Rotary Road Rally and agree to follow them. Failure to follow the RULES AND CONDITIONS may result in our immediate disqualification, at the discretion of the Rally masters.
The Bastrop County Rotary Club and the rally volunteers have not tried to contradict or minimize our understanding of the hazards and risks. We have had all our questions about the RULES AND CONDITIONS of the rally answered, and were provided with a contact telephone number if other questions or problems arise during the road rally.
To the fullest extent allowed by law, we agree to WAIVE, DISCHARGE CLAIMS, AND RELEASE FROM LIABILITY, the Bastrop County Rotary Club, its officers, directors, agents, and the road rally volunteers from any and all liability on account of, or in any way resulting from hazards and risks, even if caused by negligence of Bastrop County Rotary Club’s officers, directors, agents, and/or the road rally volunteers connected with the road rally.
We further agree to INDEMNIFY and HOLD HARMLESS the Bastrop County Rotary Club, its officers, directors, members, agents, and the road rally volunteers from any claims, damages, injuries or losses wholly or partially caused by our own negligence while participating in the road rally.
We understand and intend that this ASSUMPTION OF RISK AND RELEASE is binding upon our heirs, executors, administrators and assigns, and includes any minors accompanying us in the road rally.
This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or part is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall remain valid and enforceable.
Your signature on this acknowledgment of Responsibility also affirms your compliance with all State of Texas motor vehicle laws and regulations.
